In response, Day filed her own lawsuit on October 7th, calling the agreements "exploitative" and accusing Evans of stealing more than $1.6 million. Day claims Evans misused a $600,000 Warner Records fund and took over $1 million in royalties. Her attorney, James Sammataro, alleges that Evans left Day in financial turmoil, unable to pay credit card debt or afford a tour. The day is calling for an investigation into the matter.
