The High Court plans to hear Senator Sengezo Tshabangu's case on March 13. He is fighting to be kicked out of CCC. Professor Welshman Ncube's group removed him for breaking party rules.
Yesterday, Judge President Mary Dube met with lawyers from both sides. They set dates for when papers must be given to the court before the hearing starts. The case needs fast action because it asks who can make choices under CCC party rules.
Senator Tshabangu says Article 6 of the party rules set time limits for party leaders that ended May 27, 2024. After this date, he claims no group named in Article 6 had the right power to form a team to judge him, including Professor Ncube.
The Senator argues the team that judged him and the person picked to oversee his case had no legal right to do this job. He says Professor Ncube told these people what to do. Because of this, Senator Tshabangu believes the choice to punish him means nothing under the law.
He asks the High Court to cancel all actions taken against him by the party.
