Justice Isah Serunkuma rejected lawyer Male Mabirizi's court application at the High Court. The judge found that Mabirizi had abandoned his case and abused legal procedures. Mabirizi originally filed private prosecutions against Justice Musa Ssekaana and former Inspector General Irene Mulyagonja at Makindye Chief Magistrates' Court. The lower court dismissed these cases for jurisdictional reasons in 2022. Mabirizi then appealed this decision to the High Court in January 2024. The activist lawyer took no further action on his application after the initial filing. Justice Serunkuma noted that this inaction demonstrated lost interest and case abandonment. The court applied Section 17(2) of the Judicature Act to prevent process abuse and unnecessary delays. Legal provisions allow the High Court to supervise magistrate' decisions and examine their validity. The dismissed application joined other inactive cases during the court's routine file-clearing session.
