Ondabu argues the delay justifies private prosecution. He stated that Mwadi Women paid Sh3.8 million as required before receiving the official documents in June 2021. The brokerage firm later sent papers claiming they paid Sh8 million in stamp duty. Investigators discovered they only paid Sh240 for a sales agreement, not a property transfer.

Magistrate Ondieki has requested that all parties submit their arguments.
