Court shuts down MP aspirant’s late appeal bid

Another political hopeful gets wrecked by the calendar and a weak WhatsApp paper trail. The High Court in Kampala just shut down Patrick Kyamukaate Mutabwire's attempt to revive his parliamentary bid, ruling he missed a critical deadline to appeal his disqualification. Justice Collins Acellam dismissed the application this Wednesday, finding no special circumstances to excuse the delay.

Mutabwire sought to represent older persons in Western Uganda. The Electoral Commission nullified his nomination back on November 23rd following a rival's complaint. He claimed he only received the ruling on December 8th after pestering officials via WhatsApp. His evidence consisted largely of message screenshots.

His rival, Tuhairwe Jackson, and the Commission itself fought the request. They argued the five-day appeal window is absolute. They also attacked the WhatsApp evidence as legally inadmissible and unofficial. The Commission stated it never communicates formal decisions through private messaging apps.

The judge agreed the filing was late. Previous Supreme Court rulings allow extensions only in truly exceptional situations. Acellam stated Mutabwire failed to show extra diligence. He noted a lack of formal letters or documented follow-up attempts. Relying on casual messages was not enough.

The court found his conduct generally sluggish. No special circumstances justified using judicial discretion. The petition was subsequently struck out. Each side will cover its own legal costs. This reinforces a pattern of strict enforcement for electoral timelines.

The ruling highlights a brutal reality for candidates. Procedural missteps can end a campaign faster than political arguments. Even apparent bureaucratic delays might not save you if your evidence feels flimsy. The judiciary continues to prioritize calendar compliance over perceived fairness in these disputes.
