Nairobi erupts as Havi rages against Lagat's return over Ojwang's death

Nelson Havi has joined mounting resistance against Deputy Inspector General Eliud Lagat resuming his position. The former Law Society of Kenya President published his opposition on social media Monday. Havi stated that Lagat should remain barred from returning to his duties as DIG. The stance emerges from controversy surrounding blogger Albert Ojwang's custodial death. Police allegedly assaulted Ojwang while he remained detained at Nairobi's Central Police Station.

Lagat voluntarily suspended himself from official responsibilities on June 16, 2025. He announced that this decision would facilitate unimpeded investigations into the incident. The deputy inspector general expressed willingness to assist investigators fully. Lagat also conveyed sympathies to the deceased blogger's relatives. His temporary departure aimed to prevent any potential interference with the inquiry process.

Activist Eliud Matindi pursued legal action seeking to prevent Lagat's workplace return. The case appeared before Justice Chacha Mwita during Monday proceedings. Matindi wants judicial intervention blocking Lagat from performing any DIG functions. The activist argues that Lagat should remain suspended while investigations continue. Justice Mwita refused to grant immediate restraining orders against the deputy inspector general.

The judge instead required Lagat to submit written responses to the lawsuit by July 23. This directive allows comprehensive judicial examination of the matter through proper legal channels. Public skepticism persists regarding the circumstances of Ojwang's death. Many citizens believe Lagat's immediate return could compromise investigative integrity. Critics maintain that ethical concerns warrant keeping him away from official duties.

Lagat faces no formal criminal charges related to the blogger's death. However, opponents argue his presence during ongoing investigations raises procedural questions. The deputy inspector general prepares to resume his position despite continuing legal challenges. Court proceedings will advance while he returns to active service. The case highlights tensions between law enforcement accountability and administrative continuity.
