New Tory Lanez evidence and what the record shows

The California Court of Appeal affirmed Daystar Peterson’s three felony convictions on November 12, 2025, after reviewing the trial record and claimed errors. Debate over new Tory Lanez evidence often mixes three different things, namely what jurors heard in 2022, what later witnesses claimed, and what appellate courts accepted.

The post-conviction innocence claims from prison sit outside the original verdict unless a court allows new material into the case. Looking at the Tory Lanez evidence against him therefore starts with evidence admitted at trial, not later press conferences or social posts.

Tory Lanez's new evidence claims often focus on Kelsey Harris and whether somebody else fired the gun. The useful comparison is with the Tory Lanez case evidence already tested before the jury.

The trial record was a bundle of evidence​

Megan Pete testified that Peterson pointed a gun at her and fired as she walked away from the SUV. Minutes later, Harris texted Megan’s security contact that Tory had shot Megan and asked for 911, while police recovered a warm 9mm handgun from the vehicle. Those pieces formed part of the central Tory Lanez shooting evidence.

Medical evidence mattered too. Pete had bullet fragments in both feet, underwent surgery and physical therapy, and testified that she temporarily could not walk. The Tory Lanez trial evidence also included Peterson’s recorded jail call to Harris and later texts to Pete apologizing for what happened while saying he had been extremely drunk. The apologies did not literally say he fired the gun, an important distinction when weighing what evidence supports Tory Lanez's conviction rather than treating every apology as a confession.

Gunshot residue was found on both Peterson and Harris, but not on driver Jauquan Smith. A trial criminalist said Harris could have picked up residue by being close to a shooter and making contact afterward, so the finding did not identify a shooter by itself. Current primer gunshot residue interpretation standards likewise frame residue interpretation as an expert judgment that depends on context.

The DNA evidence was less decisive. Peterson could neither be included nor excluded as a contributor to DNA found on the gun, and he was excluded from the DNA mixture on the magazine. Investigators found no usable fingerprints. Those details matter in any serious account of Tory Lanez court evidence because the case was not built on a single forensic result.

The later claims faced a different legal test​

A prominent Tory Lanez proof of innocence claim publicized in 2025 involved a man described as Harris’s former bodyguard and driver. Lanez’s team said he recalled Harris admitting she fired three shots before Peterson grabbed her arm, after which two more shots went off. Lawyers presented the account as Tory Lanez's lawyer's new evidence, but the California Court of Appeal declined to add the material through the petitions then before it.

Later, the court separately affirmed Peterson’s convictions and sentence in the main appeal. The California appellate decision upholding the conviction left the 2022 verdict intact, and the California Supreme Court denied review on February 25, 2026. A Tory Lanez new evidence update therefore has to distinguish a public claim from evidence actually admitted in a proceeding capable of changing the judgment.

Claims about Tory Lanez's exculpatory evidence need the same distinction. A later witness statement can matter without automatically proving innocence, especially when it conflicts with testimony, contemporaneous messages, physical evidence, or earlier statements tested in court. The phrase evidence that Tory Lanez is innocent describes an argument his team continues to make, not a judicial finding overturning the conviction.

The disputed gaps are narrower than the online debate​

Some parts of the record gave the defense room to argue. Eyewitness Sean Kelly gave shifting testimony about where muzzle flashes came from, Peterson’s DNA was not on the magazine, and both Peterson and Harris tested positive for gunshot residue. Any review of Tory Lanez video evidence also needs care because no complete recording of the shooting itself was presented as decisive proof at trial.

Later civil litigation created another stream of documents and testimony, but it was legally separate from the criminal conviction. Peterson was held in contempt during a deposition dispute connected to Megan’s lawsuit against Milagro Cooper, and that civil case later ended with a monetary judgment on emotional-distress and deepfake claims. None of those proceedings replaced the Tory Lanez Megan Thee Stallion case evidence the criminal jury considered.

The record remains narrower than either side’s social-media version. The conviction rested on Pete’s identification, Harris’s immediate message, the recovered gun, injury evidence, residue findings, Peterson’s post-incident apologies, and the jury’s assessment of conflicting witness accounts.
