Shumuk ordered to pay 14 billion shillings for squatting on the Shumuk House units

Talk about a catastrophic legal L for a Ugandan tycoon. Businessman Mukesh Shukla, also called Shumuk, just got hit with a court order to pay a staggering 14 billion shillings for illegally holding onto 24 condominium units in Kampala's Shumuk House. High Court judge Stephen Mubiru ruled that Shukla and his companies had no right to occupy those units, which were legitimately bought by two other men, Joseph Sempebwa and Peter Lule. The judge found Shukla was not a bona fide purchaser, meaning he should have known about the prior claims. Shukla must now fork over around 13.7 billion shillings in mesne profits to Sempebwa, plus another 211 million for monthly damages on 13 units until he vacates next year, and an extra 50 million to Lule.

The judge blew up Shukla's entire claim because of a fundamental title error. The property on Colville Street had been legally converted into 92 separate condominium units, which voided the original "mother" land title. Shukla's companies had made agreements to buy that now-nonexistent parent title from the late owner, Bonney Katatumba, after Katatumba had already sold specific units to others. Judge Mubiru stated that a contract for a defunct parent title is void, and you cannot sell what you do not own. Since Katatumba no longer owned the 24 individual units, he could not pass a valid title to Shukla. The court also ordered the land commissioner to issue title deeds to Sempebwa once the Kampala District Land Board renews the leases.

This case started back in 2009 when Shukla and his firms sued to block the sales to Sempebwa and Lule. The dispute stemmed from Katatumba's separate sales of units to Mohamedalli (who sold to Sempebwa) and directly to Lule, before later making shaky bulk sale agreements with Shukla's company. Those later deals fell apart, and the promised payments to the original buyers never happened. The court dismissed Shukla's suit entirely, reinforcing that condominium ownership creates separate legal titles for each unit, making a bulk purchase of the whole building impossible without dealing with each unique title.
