Banker Nicholas Vingirai has filed a formal complaint with the High Court's Judge President against Justice Joel Mambara. Vingirai accuses the judge of issuing rulings on matters that were never argued in court. The dispute stems from a case where Vingirai claims the judge was only supposed to consider preliminary points, but instead granted full rescission of a prior judgment and joined new parties, relief none of the lawyers had requested.
Vingirai called the actions highly unethical and damaging to judicial integrity, stating the judge ruled on an application that was not actually before him. He noted that a separate, proper rescission attempt by the opposing side had already been dismissed by a different judge.
