Kahawa courtroom chaos as prosecution walks out on Mukunji terror case

Chaos erupted at Kahawa Law Courts when defense lawyers battled prosecutors over a terrorism case. Three men face serious charges connected to the July 7 street demonstrations. MP John Mukunji, reporter James Mbochi, and motorcycle taxi driver Stanley Mbuthia were arrested during the protests. Police claim they helped fund the demonstrations and planned terrorist activities. The defense team wanted to question the main investigating officer about the case.

Prosecutors became angry when defense lawyers started asking tough questions. State Counsel James Machira led his team out of the courtroom in protest. The prosecution later demanded the court throw out all the questioning sessions. They argued the court had no power to allow such proceedings. Defense lawyer Kibe Mungai fought back against these claims.

Mungai told the court that prosecutors cannot pick and choose when to follow court rules. He said the state brought the case to court first and must accept the consequences. The prosecution cannot demand detention for suspects and later claim the court lacks authority. Magistrate Richard Koech agreed with the defense arguments. He ruled that the questioning was completely legal and valid.

The magistrate refused to cancel any part of the court proceedings. He said prosecutors chose not to participate but the process continued anyway. The case will resume on July 10 for more hearings. Police want to keep all three suspects locked up for 14 more days at Muthaiga Police Station.
