Maraga accuses Ruto of terror law travesty on Gen Z at Kahawa courts

Former Chief Justice David Maraga condemned government actions following mass arrests of young protesters from recent demonstrations. Authorities detained dozens of participants from June 25 and July 7 rallies on terrorism charges alongside arson and property destruction allegations. Maraga appeared at Kahawa Law Courts to support the accused demonstrators during their bail hearing. The retired jurist warned that criminal justice mechanisms were being weaponized to intimidate detained youth and their relatives. He argued that applying anti-terrorism legislation to protest cases threatens constitutional assembly rights.

The former chief justice criticized the disproportionate involvement of specialized anti-terrorism units in demonstration-related prosecutions. Maraga emphasized that detained individuals should not face arbitrary imprisonment or bail denial. His legal team advocated for reasonable bond conditions that consider the financial limitations of young defendants. The court ultimately approved bail terms of Sh200,000 with alternative cash payment of Sh50,000. Maraga pledged continued support for citizens exercising peaceful assembly privileges.

Kenya has experienced persistent youth-led demonstrations since last June driven by economic grievances. The Finance Bill 2024 initially triggered protests due to proposed tax measures citizens considered harsh. Recent rallies resumed following teacher Albert Ojwang's custody death with demands for governance reforms and police accountability. President Ruto has vowed strong action against protests he claims contain destabilizing elements. The administration recently authorized officers to use force against demonstration looters.
