MPs Booted From Local Funds in Court Shock

Reverend Moses Nkhana from the Mzimba Youth Organization praised a court decision made Monday about development funds. The Constitutional Court ruled that 2022 rules for the Constituency Development Fund and Water Resource Fund break the law. Members of Parliament had been controlling these funds and using them during election campaigns. The court said lawmakers cannot manage money and watch over it at the same time. This creates serious problems for honest government operations.

Judges found that giving MPs control over local development money violates the separation of powers principle. Lawmakers must focus on making laws and checking government work rather than running fund programs. The court ordered immediate changes to remove politicians from managing these financial resources. District councils and local committees will likely take over these duties from elected officials. Each area receives K220 million per year through the development fund system.

Legal experts believe this ruling will reduce political interference and improve transparency across Malawi. Civil society leaders support the decision because it protects public resources from campaign misuse. The government must change current guidelines to follow the court order properly. Parliament and the Ministry of Local Government face pressure to implement reforms quickly. This landmark case represents a major step toward better accountability.
