Shebe Maburna fights for bail over Polokwane shooting charges

Shebe Maburna is making another bid to get out of jail. The Lekompo star, whose real name is Lehlogonolo Chauke, has returned to court in Polokwane with fresh claims aimed at securing bail after his first attempt failed.

The case stems from gunfire in Ladanna, where a fan suffered an injury. Prosecutors have filed 21 criminal counts against the musician, with four alleging attempted murder. Other accusations involve physical attacks and damage to property.

During questioning, state lawyer Kgaugelo Lekoloane pressed Chauke on his account of the events. The musician denied being anywhere near the alleged attack. He also claimed police investigator Captain Phaladi Makola had a grudge against him and wanted to pin the case on him.

Another claim raised eyebrows. Chauke alleged a family link between Makola and one of the people who filed complaints. Those claims remain disputed, and the court has yet to rule on their significance.

His legal team also raised issues with the bail process. According to Chauke, prosecutors kept adding criminal counts, which left him unable to seek release through the Regional Court. The defense had earlier sought more time to prepare its case.

But Lekoloane challenged parts of the musician's account. Some details in his sworn papers were missing or unclear, with questions arising over a person Chauke claimed had traveled in his car during the incident.

Magistrate Godfrey Netshiozwi allowed extra time for the paperwork to be fixed. Chauke's lawyers then sought permission to strike out parts of an earlier statement, arguing that its events appeared in the wrong sequence. More questioning is expected as the hearing moves ahead.

His past effort to secure freedom had centered on his health. Chauke told the court he needed specialist treatment for a leg injury from a road accident. A magistrate rejected that request, and a High Court appeal failed as well.

The defense has since pointed to what it sees as gaps in the evidence. Lawyers argue that investigators have no video in the case file that places Chauke at the shooting location. They also say prior bail hearings did not give enough weight to ballistics findings and other records.

Prosecutors still want him held while the case moves through the courts. Chauke remains behind bars, and the latest request depends on whether the judge accepts the new material as grounds for release. No verdict has been reached on the criminal allegations, and he retains the presumption of innocence.
