U.S. court says X must answer for its own negligence on CSAM

The U.S. Court of Appeals for the Ninth Circuit has permitted a negligence lawsuit against X to proceed. Two minor plaintiffs accused the social media platform of inadequate response when they reported child sexual abuse material circulating on the site. The content remained accessible for several days despite repeated notifications from the victims. X failed to promptly contact the National Center for Missing and Exploited Children about the material. Judge Danielle Forrest determined the company must defend its handling of the situation in court.

Section 230 of the Communications Decency Act typically shields platforms from liability regarding user content. The court maintained most legal protections under this legislation but held X accountable for its response procedures. This ruling establishes that companies cannot ignore their internal processes when addressing such reports. Tech platforms face growing expectations to actively monitor and respond to exploitation cases. The decision signals courts will examine how social media companies handle sensitive user safety issues.
