Zimbabwe judge urges courts to hand seized mbanje to licensed dealers, not destroy

High Court Justice Munamato Mutevedzi challenged the automatic destruction of confiscated cannabis during a drug trafficking case review. The judge argued that seized marijuana should transfer to licensed medical and research facilities rather than face incineration. His comments emerged while examining Tapfuma Moyo's conviction for possessing over 40 kilograms of cannabis at Beitbridge Border Post. Zimbabwe permits medicinal and research cannabis cultivation since 2018, creating legal pathways for the substance.

The magistrate originally sentenced Moyo to 15 years imprisonment with six years suspended for good behavior. Justice Mutevedzi maintained the conviction but reduced the effective sentence to six years while questioning the destruction directive. He proposed that courts should forfeit drugs to state authorities who can determine appropriate disposal methods. The judge emphasized that this approach does not weaken judicial opposition to illegal drug activities. Courts must continue fighting substance abuse while recognizing legitimate cannabis applications within current legal frameworks.
