A Kampala court threw out Elias Nalukoola Luyimbazi as the elected lawmaker for Kawempe North. Justice Bernard Namanya decided after Faridah Nambi Kigongo from the National Resistance Movement filed a complaint. She said the voting process had serious problems. The judge agreed with her claims about unfair election practices and ordered a new vote.
The court found two major problems with the election. First, more than 16,000 people could not vote even though they should have been able to. This large number significantly changed the final results. Second, Nalukoola broke the law when he campaigned at polling stations on election day itself. The Parliamentary Elections Act makes this campaigning illegal on voting day. Officials must conduct a fresh election to replace the canceled results. Both sides will pay their legal fees separately. The Electoral Commission will run the new voting process.
