Court Overturns Ruling, Awards Full Compensation to Tuk-Tuk Driver

A tuk-tuk driver just scored a major victory against a publishing company after getting slammed from behind. The High Court tossed out a crazy decision that blamed him for the crash. Justice Asenath Ongeri ruled the three-wheeler operator deserved every penny of his compensation claim. The driver walked away with 295,000 shillings after fighting the unfair verdict. His small vehicle got crushed when the company truck smashed into his rear bumper.

The original court made a shocking mistake when it cut his repair money. Judges said the tuk-tuk man caused 20 percent of the accident and slashed his payout. They also refused to pay him for months of lost work despite clear evidence. The driver hauled them to the High Court because he knew the decision stunk. He proved the other guy hit him from behind and deserved zero blame.

Justice Ongeri agreed that rear-end crashes always favor the victim unless proven otherwise. She restored his full repair costs of 135,000 shillings after the lower court wrongly reduced them. The judge also awarded him 150,000 shillings for ten months of missed earnings. She added another 10,000 shillings for police and assessor fees that got ignored earlier. The publishing company must pay everything back with interest from when he first filed the case.
