Court tosses Ssemakadde’s bid to stall indecency trial

Legal drama just faceplanted after a lawyer hired a fake attorney to pause his trial. Magistrate Ronald Kayizzi tossed the request from Isaac Kimaze Ssemakadde to stop criminal proceedings regarding indecent insult charges. The judge ruled the entire move was procedurally wrecked because the supporting documents came from someone pretending to be a qualified advocate.

Court records proved Brian Akandwanaho is not actually enrolled despite swearing the affidavit as counsel. Kayizzi declared that an unqualified person cannot legally submit sworn statements about judicial conduct or representation. This revelation left the initial application with zero evidence, forcing the court to strike it down immediately.

Ssemakadde tried fixing the mess with a fresh affidavit from Ntale Rogers but failed to get permission first. The magistrate rejected this sneak attack, noting that replacing the witness introduced totally new facts just to dodge objections from private prosecutors Tonny Tumukunde and Joshua Byamazima.

Kayizzi added that merely filing a constitutional petition does not automatically freeze lower court cases without specific orders. He directed the trial to proceed normally while warning that Akandwanaho could face investigation for impersonating an officer of the court.
