Diddy's amateur porn defense fails to impress judge

A federal judge rejected Sean Diddy Combs' motion for a new trial or acquittal before his Friday sentencing. Judge Arun Subramanian ruled that the defense's arguments regarding First Amendment protections for recordings and prejudicial charge combinations failed to meet the legal standards. The court found no spillover prejudice since jurors acquitted Combs on the more severe RICO and sex trafficking charges.

Prosecutors filed a 164-page recommendation on Monday, seeking at least 11 years' imprisonment and describing the defendant as unrepentant. Defense attorneys requested no more than 14 months and submitted support letters from Yung Miami, their former girlfriend, and producer Dallas Austin. The government initially suggested four to five years, but increased the recommendation based on the severity of Combs' offenses. Subramanian wrote that prosecutors had proven their case multiple times and found no grounds for retrial.
