Eleven Music screening does not license reference audio

ElevenLabs checks every Audio Reference upload for copyright matches before Music v2 can use it to guide a new generation. Tracks that match recordings owned by others are blocked. A passed check only means the platform accepted that file for generation, not that you were entitled to supply it.

That distinction sits outside the paid-plan rights attached to generated tracks. Output permission can be broad, even for paid commercial releases, while the source recording remains somebody else's property.

Audio Reference guides sound, production style, instrumentation, tempo, and mood. ElevenLabs says it does not copy or remix the upload and returns a newly generated composition rather than an edited copy of the reference. None of that converts automated screening into a license.

Copyright screening cannot prove your upload rights​

The published safeguard is described as a match check against recordings owned by others. It is not described as reviewing your split sheet, label deal, beat lease, work-for-hire clause, sample clearance, session agreement, or private client contract.

A failed match produces a clear answer and blocks the reference. A successful pass produces only the narrower fact that the system found no blocking match. It says nothing about an unregistered master, an obscure catalog, a private demo, or a collaborator whose contract gives them approval rights.

Use your own recording as an AI reference only after checking who owns both layers inside it. The sound recording and underlying composition are separate works, commonly controlled through different contracts and sometimes by entirely different people.

You may own the master but share the song with co-writers. You may control the composition but have signed the recording to a label that restricts third-party processing. A cover can leave the composition under another owner's control even when the performance and studio recording are yours.

Samples, leased beats, commissioned vocals, and producer contributions add more permission checks. Permission to distribute a finished song does not automatically include permission to provide its underlying material for analysis, modification, derivative creation, and sublicensing under a platform agreement.

Every reference track carries two layers of rights​

ElevenLabs' Music Terms remove any ambiguity about what enters the service. A supplied sound recording and the musical composition embodied inside it both count as Input. Your upload promise therefore reaches the master, the melody and lyrics, and any protected material fixed within them.

The standard terms say you must hold every right needed to grant the company its content license. They also make you promise that the content and the company's permitted use of it will not violate anyone else's rights or cause injury.

That can involve more than a copyright registration. A session singer may have contractual or publicity rights, while a client may own a commissioned sonic logo or unreleased campaign track. A producer might control the master even though the final file sits on your drive.

Possession is weak evidence. Export access from a DAW, shared cloud folder, email attachment, or client portal shows that you have a copy, not that you can authorize machine processing and sublicensing.

A clean clearance file should identify the recording owner, composition owners, performers, samples, and any limits in third-party licenses. Written approval should cover upload to an AI music service and use as creative guidance for a new generation with commercial output. That is a rights-cleared reference recording in practical terms.

The platform license reaches beyond one generation​

Uploading does not transfer ownership to ElevenLabs, but it grants the company substantial permission over the material supplied. The standard content license covers use, reproduction, modification, adaptation, derivative works, distribution, public performance, and display.

It supports service delivery, trust and safety, service improvement, and development of new products. The license is described as perpetual, irrevocable, nonexclusive, royalty-free, worldwide, and sublicensable through multiple tiers. Because Music treats both the recording and composition as Input, the grant reaches both rights layers rather than the audio file alone.

Account holders can opt out of future content use for training through the data settings. The terms say processing the request does not undo earlier uses or materials resulting from them, and it does not repair missing permission for an upload already made.

Input clearance also does not finish the output review. Music is supplied without a non-infringement warranty, and customers must not deploy output they knew or should have known was reasonably likely to infringe protected rights. Listen for a recognizable melody, lyric, sample, performance, or artist-like vocal identity before approving a commercial release.

Keep the source file, ownership documents, consent records, upload date, terms version, and generation identifiers together. If the rights chain is incomplete or the output sounds recognizably similar to protected material after a careful listening review, do not publish it.
