Justice Mwita spots lawyer's unease, derails Ndiang'ui case

Legal disputes over representation delayed a High Court hearing until July 24. Justice Chacha Mwita identified conflicts between parties claiming authority to speak for petitioner Ndiang'ui Kinyagia. The judge expressed concern about contradictory affidavits filed by different representatives. Attorney Kibe Mungai explained that family members changed documents without consulting him first. He told the court that relatives felt uncomfortable with the original affidavit content.

The Law Society of Kenya plans to question witnesses about the conflicting statements. Justice Mwita observed visible tension during lawyer presentations to the court. Family attorney Lilian Gitonga faces examination alongside Ndiang'ui and his mother regarding a July 3 affidavit. The judge stated that meaningful progress requires a clear identification of the official spokesperson. All parties must resolve these representation issues before the next scheduled appearance.
