Prosecutor in hot water over fraud indictments

Mike Chimombe and Moses Mpofu, two businessmen connected to the Zanu PF party, are facing corruption charges. However, Prosecutor General Justice Loice Matanda-Moyo has landed herself in a difficult situation regarding their case. The Zimbabwe Litigants Association, a group, has filed an application requesting the court to invalidate her decision to indict Chimombe and Mpofu to the High Court.

The association wants the Judicial Service Commission (JSC) and the Justice Minister to make sure that the decision is followed. They believe that the Prosecutor General's choice to bring charges against the two businessmen in the High Court is not valid. The group has taken legal action to challenge this decision.

If the court agrees with the Zimbabwe Litigants Association, the corruption charges against Chimombe and Mpofu might not proceed in the High Court as planned. This would be a setback for the Prosecutor General, who has decided to prosecute the two men in that court.

The outcome of this application filed by the association will determine whether the corruption case against the Zanu PF-linked businessmen will proceed in the High Court. It will also have implications for the Prosecutor General's authority to make such decisions in the future.

The case has spotlighted the Prosecutor General and her role in deciding where to prosecute individuals accused of corruption. It raises questions about the independence and impartiality of the decision-making process in such cases, especially when they involve people with political connections.
