StubHub checkout terms pushed Louis Sanquini’s lawsuit out of court and into arbitration. Judge Jed S. Rakoff found the New York buyer accepted the deal when he completed his purchases after StubHub displayed linked user terms near the payment control. Those rules also block class claims and gave buyers 30 days to reject arbitration.
Sanquini accused StubHub and CEO Eric Baker of presenting the platform as neutral while Baker held an interest in reseller Andro Capital. Rakoff did not decide whether those claims were true. Instead, he found no real fight over Sanquini’s agreement to arbitrate and rejected his argument that StubHub’s contract setup was unfair.
Baker can use the same arbitration clause despite not signing the agreement, Rakoff found, because Sanquini treated him and StubHub together across his claims. The complaint cites purchases for KISS and a New York soccer match, with one order carrying $131.48 in ticket costs and $76.34 in fees. The proposed class stays paused while arbitration moves ahead.
