Swiss man jailed over anti LGBTQ Facebook post

A Swiss court sentenced Emanuel Brunisholz to 10 days in prison for a 2022 Facebook post questioning gender identity concepts. The wind instrument repairman stated that skeletal remains reveal only male and female structures after 200 years and called alternative views mental illness promoted through education. Authorities charged him with discrimination and incitement to hatred under national anti-discrimination statutes.

Brunisholz refused to pay a 500 Swiss franc fine and accepted jail time beginning December 2. Regional appeals failed in 2023, resulting in an additional 600 francs in legal costs. Tesla CEO Elon Musk responded to the case on social media with exclamation marks after users highlighted the imprisonment for the comment. The businessman has criticized restrictions on speech across European nations and discussed transgender issues affecting his family.
