The power struggle within Zimbabwe's CCC party has taken a new turn. Senator Sengezo Tshabangu has refiled an appeal with the Supreme Court. He had briefly withdrawn it due to a filing error.
Sen. Tshabangu is challenging a January High Court ruling. The ruling said he could not reassign CCC legislators to different Parliamentary committees and voided Sen. Nonhlanhla Mlotshwa's appointment as the party's Chief Whip.
The Welshman Ncube faction of CCC supported the High Court decision. They saw the initial appeal withdrawal as a win for their side.
But Sen. Tshabangu and Sen. Mlotshwa say the withdrawal was just to fix a mistake. They have corrected it and refiled the appeal. They believe they have a strong case.
CCC spokesman Nqobizitha Mlilo hinted at more drama to come. He said the full story would be shocking. He hopes the opposing faction will reconsider their actions.
The appeal makes several arguments against the High Court judgment. Sen. Tshabangu says the court lacked jurisdiction and made errors in procedure and interpretation.
He disputes the ruling that certain CCC members were appointed to a key committee for a full term and the finding that his actions amounted to an illegal recall of MPs.
Additionally, the appeal defends Sen. Mlotshwa's appointment as Chief Whip. It says the High Court was wrong to declare the position unlawful.
The outcome of this case will have major implications for control of the CCC. The party remains divided as the legal battle moves to the Supreme Court.
