David Mark ADC suit stalled in Abuja over improper court papers

Federal High Court proceedings stalled Monday when Justice Emeka Nwite discovered improper service of legal documents against African Democratic Congress leadership. Plaintiff counsel Michael Agber failed to serve papers correctly on David Mark, Rauf Aregbesola, and Ralph Nwosu as defendants. The court found no valid proof of service within case files during examination.

Agber attempted serving defendants through ADC party channels rather than individual delivery as required by law. Justice Nwite rejected this method and demanded proper substituted service orders before proceeding. The judge rescheduled hearings for September 30 after granting adjournment requests from plaintiff representation.

Former ADC Deputy National Chairman Nafiu-Bala Gombe initiated legal action seeking restraining orders against Mark's party leadership assumption. The suit challenges INEC recognition of Mark and Aregbesola as national chairman and secretary respectively. Senior Advocate Shuaib Eneojoh Aruwa represented ADC interests while disputing adequate legal service compliance throughout Monday proceedings.
