Getting Your Foreign Divorce Noted in Zimbabwe

In Zimbabwe, a foreign divorce decree must be registered locally, even if it was validly obtained abroad based on the husband's country of residence. The law recognizes marriages contracted in other nations as long as certain conditions are met at the time of the union.

According to the Marriages Act, an international marriage is deemed legal in Zimbabwe if neither spouse was already civilly married or wed under a third country's laws prohibiting marriage while still married there. The couple also cannot be related within a degree banned by the Criminal Law Code regarding sexual relations.

Additionally, both parties must have been at least 18 years old and mentally capable of consent. The law requires that each person freely and fully agree to the marriage. If these criteria were satisfied when the couple wed overseas, Zimbabwe would acknowledge the validity of their foreign union.

Many married couples are moving to various locations around the globe these days. Sometimes, both individuals reside in the same nation, but in other cases, the spouses may live in separate countries. Regardless, registering a foreign divorce order locally ensures it is officially recognized under Zimbabwean law.
