High Court freezes Media Council of Kenya board appointments by William Kabogo

Justice Bahati Mwamuye granted conservatory orders that prevent four Media Council of Kenya appointees from taking office. The court action blocks Joseph Maina Muiruri from assuming the chairperson role alongside members Susan Karago, Timothy Wanyonyi Chetambe, and Tabitha Mutemi. ICT Cabinet Secretary William Kabogo had published their appointments through Gazette Notices 10091 and 10092 on July 25, 2025. Three petitioners filed the constitutional challenge questioning the selection process. The court will examine whether proper procedures were followed during the appointment phase.

Issa Elanyi, Patrick Karani, and Paul Ngeywo argue that public participation requirements were ignored during candidate selection. They contend the selection panel lacked proper formation under the Media Council Act provisions. The petitioners assert these procedural failures threaten the regulatory body's required independence. Their legal challenge seeks compliance with constitutional standards for such appointments. A virtual court session will occur on September 9, 2025, with written submissions due by September 5.
