ICJ delivers landmark ruling on climate change obligations, holding states accountable for emissions

The International Court of Justice issued a unanimous advisory opinion Wednesday establishing legal obligations for nations addressing climate change. President Iwasawa Yuji acknowledged human activities cause greenhouse gas emissions and create an urgent existential threat. Vanuatu and other Pacific Island nations initiated the case following a 2019 youth-led campaign. The court addressed two fundamental questions about state obligations under international law and consequences for failing to meet them.

Climate experts consider this ruling a powerful legal tool that will accelerate global litigation. Courts worldwide will likely reference this decision in future cases against fossil fuel companies. The opinion requires more than voluntary action from historical polluters who must reduce emissions and compensate affected communities. Law students from the University of the South Pacific conceived the groundbreaking campaign with support from over 1,500 organizations.
