Pakistan's PCA strengthens Army Chief role, grants lifelong immunity

Pakistan's proposed Twenty-Seventh Constitutional Amendment would grant unprecedented authority to the Army Chief by merging military leadership roles and creating a constitutionally protected Field Marshal position with lifetime immunity. The legislation eliminates the Chairman of the Joint Chiefs of Staff Committee and transfers command authority over all armed forces to the Army Chief, who would also serve as Chief of Defense Forces.

The amendment establishes permanent constitutional status for any officer promoted to Field Marshal, allowing retention of rank and uniform for life while providing immunity from criminal proceedings similar to presidential protections. Current Army Chief Asim Munir recently received the Field Marshal title following border hostilities with India. Under the proposed framework, removal would require parliamentary impeachment rather than standard executive authority, potentially politicizing military leadership and creating incentives for armed conflict.

Legal analysts warn that the lifetime immunity provision could shield Field Marshals from prosecution for constitutional violations, including high treason charges, effectively placing military leadership above civilian oversight and undermining accountability principles central to democratic governance.
