Peponi Road Land Grab Backfires on Govt

Appeals court judges sided with Belgo Holdings against the Kenya Urban Roads Authority over disputed Nairobi land. The company won rights to 44 acres on Peponi Road after decades of legal battles. Government agencies claimed they bought the property in 1975 but never finished the required paperwork. Belgo purchased the land in 1995 for 20 million shillings from legitimate sellers. Court records show no evidence of completed government acquisition or payment receipts.

Belgo director Akber Ismail discovered bulldozers building roads on company property during August 2011. Workers dumped soil and laid foundations without permission from the landowners. Government construction continued for weeks despite protests from Belgo representatives. The company had paid taxes and land rates to the Nairobi City Council since acquiring the property. Previous court cases during 2005 and 2016 confirmed Belgo's legal ownership rights.

Appeals judges awarded 22 million shillings in damages for illegal trespass and construction activities. Courts issued permanent orders stopping the road authority from entering the disputed property. Government lawyers failed to prove that proper land acquisition procedures had happened decades earlier. Belgo Holdings demonstrated valid title documents and constitutional property protection. The ruling reinforces legal requirements for government land purchases.
