RedForce Debt Management won a court battle against rival company Qaurtile Debt Collection. The fight centered around a 48 million dollar contract to collect money for TransNamib. Judge Thomas Masuku ruled that Qaurtile waited too long to file their legal papers. The company heard about RedForce winning the contract on April 8 but only went to court 22 days later. Masuku said parties cannot jump ahead of other cases without good reasons.
Qaurtile wanted the court to cancel RedForce contract and call it illegal. They claimed TransNamib gave away the work unfairly and blocked fair competition. The judge refused to hear these other complaints because Qaurtile missed the deadline. RedForce already started collecting the debt and recovered 4 million dollars between April and May. Chief executive Julius Nyamazana said his company feels happy to continue working.
The court ordered Qaurtile to pay legal costs for both TransNamib and RedForce. Masuku struck the case from court records after making his decision. TransNamib spokesperson Kendall Swartz said the company needed time to check with finance and procurement departments before commenting. The ruling allows RedForce to keep collecting outstanding money from debtors. Qaurtile must cover all expenses from the failed legal challenge.
