Kapseret MP Oscar Sudi dropped all charges against 16 young people accused of wrecking his Timba XO Club during protests in Eldoret. These youngsters faced legal trouble for allegedly taking items valued at Sh78 million from the club and damaging property worth more than Sh80 million at the establishment. Law enforcement arrested them following a demonstration on June 25 when people broke into and damaged the popular Eldoret nightspot.
The case ended after Principal Magistrate Cherono Kesse accepted a request from Timba director Samwel Lamayan. Prosecutor Silvester Thuo asked Lamayan why they decided to abandon the legal action. Lamayan explained that Sudi referred to the accused as "our children" and chose to forgive them completely. He added that Sudi instructed him to pull back the case because he had no desire to punish the youth.
Magistrate Kesse officially dismissed the matter after hearing from both sides. Every young person expressed thanks to Sudi and the court for the decision. One defendant apologized for their actions and thanked Sudi for his forgiveness. He mentioned that most defendants lack jobs and requested Sudi consider helping them avoid future problems.
The youth originally faced six different charges, including theft, possession of stolen items, and destroying property at Timba XO Club during the June protests. Court documents claimed they broke into the lounge located in the Sukunanga area along the Eldoret-Nakuru highway. The alleged stolen items included speakers, televisions, lighting equipment, food, alcoholic beverages, laptops, computers, kitchen tools, and gas tanks. Their lawyers had previously asked the court for reasonable bail terms.
Attorney George Sonkule expressed appreciation toward Sudi for forgiving the young defendants and allowing them to move forward with their lives.
