Actual knowledge

Actual knowledge means a person knows the material facts at issue. It is not rumor, guesswork, or a hunch. A buyer who reads the contract and sees the price and date has actual knowledge of those terms. A witness who watched the event and remembers who acted and what happened holds actual knowledge of those facts. A landlord who sees clear damage from a leak has actual knowledge of the problem.
