Lawyer defends officer accused of murder, demands bail

Defense attorney Vincent Yegon has pressed the Milimani High Court to grant bail to Police Constable Klinzy Masinde Baraza, who faces murder allegations stemming from the fatal shooting of mask vendor Boniface Mwangi Kariuki outside a Nairobi commercial building. The lawyer emphasized constitutional protections for accused individuals during a hearing before Justice Margaret Muigai, asserting that the presumption of innocence requires the court to consider release unless prosecutors demonstrate exceptional circumstances.

Yegon challenged prosecution assertions that the Kayole-based officer might flee, noting authorities failed to substantiate their risk assessment with actual evidence. Article 49 guarantees provisional freedom pending trial, absent a substantial justification for detention, the defense counsel argued.

The murder charge relates to events that occurred at Imenti House within the capital's central business zone, with prosecutors alleging violations of penal statutes governing unlawful killings.
